Product Specific Terms And Conditions - Hosting

THESE PRODUCT SPECIFIC TERMS AND CONDITIONS ARE CONCLUDED IN CONJUNCTION WITH THE EASYWEB GENERAL TERMS AND CONDITIONS AND APPLICABLE SERVICE ORDER FORM WHICH SHALL ALL BE READ AS ONE AGREEMENT.

1. DEFINITIONS AND INTERPRETATION

1.1. Capitalised terms not defined in these Product Specific Terms and Conditions shall have the same meaning as defined in the Easyweb General Terms and Conditions;

1.2. Unless inconsistent with the context, the words and phrases set out below shall mean as follows:

1.2.1. “Hosted System” means a combination of shared hardware and software to which Easyweb provides the Customer access via the internet for the purposing of hosting the Customer’s content;

1.2.2. “Personally Identifiable Information” or “PII” means a combination of any information that identifies an individual with that individual’s sensitive and non-public financial, health or other data or attribute, such as a combination of the individual’s name, address or phone number with the individual’s identification number, passport number or other government issued number, financial account number, date of birth, address, biometric data, mother’s maiden name, or other “Personal Data” or “Special Categories of Data” as defined the Protection of Personal Information Act No.4 of 2013;

1.2.3. “Service Effective Date” means the date on which Easyweb provides the access codes that enable the Customer to send and receive information from the Customer’s Hosted System;

1.2.4. “Shared Hosting” means Easyweb’s provision for the Customer’s use of the Hosted System described in the Services Description;

1.2.5. “Support” means (i) the management of the Hosting Services by a service delivery team that includes a team leader, account manager and support specialists with training and experience in hosted systems; (ii) availability of support restricted to Business Hours as defined in the General Terms and Conditions; (iii) any specific support services described in the Services Description; and (iv) the use of the Easyweb Hosting Customer Portal.

2. SERVICE DESCRIPTION

2.1. Easyweb’s Shared Hosting is a fully managed, economical web hosting solution that allows the Customer to share server space with other customers. Designed for small to medium-sized businesses, this solution is ideal for the Customer requiring a low-cost hosting solution or an Internet market presence. Shared Hosting provides increased performance, stability and server resources.

2.2. Easyweb fully manages the Hosted System, keeping the service associated with the Customer’s website on the latest security patches and upgrades and ensuring optimum performance.

3. DEPLOYMENT GUARANTEE

Unless otherwise stated in the Service Order Form, Easyweb does not guarantee a deployment timeframe but will use reasonable endeavours to configure the Customer’s access to Hosted System promptly.

4. ENCRYPTION OF PERSONALLY IDENTIFIABLE INFORMATION

4.1. The Customer acknowledges that it is solely responsible for all security measures required in respect of the Hosting Service(s) and Easyweb shall not be held liable for any losses arising out of any security breaches of the Customer’s Hosting Service(s).

4.2. Easyweb shall not be liable to the Customer for any losses of whatsoever nature arising from malware, ransomware, phishing, vishing, or any similar malicious attach on the Customer and specifically, for the Hosting Services, this includes encrypting any PII transmitted to or from, or stored on, the Easyweb Hosting server(s) or storage devices used by the Customer.

5. VIRTUALISATION

While the Customer’s virtual server(s) is/are in an “inactive” status Easyweb will not install any software updates that Easyweb may have otherwise agreed to install. Easyweb shall update the Customer’s virtual server(s) when the Customer returns such server(s) to “active” status after which there may be a delay of up to 24 (twenty-four) hours before the updates are complete installed.

6. IP ADDRESSES

On termination of the Hosting Services the Customer must promptly release any Internet protocol numbers, addresses or address blocks assigned to the Customer in connection with the Hosting Services (but not any URL or top level domain or domain name) and the Customer agrees that Easyweb may takes step to change or remove any such IP addresses.

7. UNSUPPORTED CONFIGURATION ELEMENTS OR SERVICES

If the Customer requests Easyweb to implement a configuration element (hardware or software) or Hosting Service in a manner that is not customary at Easyweb or that is in “end of life” or “end of support” status Easyweb may designate the element or Service as an “Unsupported Service” in the Service Order Form. Easyweb makes no representation or warranty whatsoever regarding an Unsupported Service and the Customer agrees that Easyweb shall not be liable for any loss or damage arising from the provision of the Unsupported Service.
The Service Level Guarantees shall not apply to the Unsupported Service or any other aspect of the Hosting Services that may be adversely affected by the Unsupported Service.
The Customer acknowledges that Unsupported Services may not inter-operate with Easyweb’s other Services such as back-up or monitoring.

8. DOMAIN NAME

8.1. The Customer acknowledges that, in order to register a domain name, an agreement between the Customer and the relevant Network Information Centre (NIC) must be concluded. The terms and conditions of the relevant NIC will apply to such agreement.

8.2. The Customer authorises Easyweb to enter into the relevant agreement with the NIC on behalf of the Customer.

9. CUSTOMER CONTENT

9.1. The Customer, and not Easyweb, has the sole and exclusive control over the content residing on that part of the Hosted System provisioned for the Customer’s use (the “Customer Content”).

9.2. The Customer acknowledges that Easyweb (whether directly or indirectly) is not provided with access to the Customer Content, will not seek access to the Customer Content and will not exercise any control over the Customer Content.

9.3. Unless specifically agreed to the contrary, the Customer is responsible for ensuring that the Customer Content is backed up and archived. Easyweb will not accept any liability for any loss of Customer Content.

9.4. The Customer will not store any illegal information in any storage device allocated to it by Easyweb.

9.5. The Customer shall promptly and thoroughly respond to any notices sent to the Customer by Easyweb in respect Customer Content that is believed to violate applicable laws.

9.6. The Customer acknowledges that Easyweb is obliged to take down the Customer’s content if a take-down notice as envisaged in the Electronic Communications and Transactions Act is directed at Easyweb. In such events, Easyweb shall have no liability whatsoever to the Customer for acting on such a take-down notice.

10. ACCURACY OF CUSTOMER INFORMATION

10.1. The Customer will provide Easyweb with accurate and up-to-date information when:

10.1.1. completing the Service Order Form; and

10.1.2. contacting Easyweb to report a suspected fault and is asked a standard set of structured questions.

10.2. Easyweb shall not be liable for any loss suffered as a result of the Customer’s failure to provide accurate information or any relevant facilities which may lead to a delay in service repair.
